Aug. 24, 2005 — Florida prosecutors say they will not try the man who choked another man to death during a fight in a McDonald's parking lot.

The April 24, 2005, fight between Martin Robless-Taylor and Anthony Makowski, who died from strangulation, was caught on tape by a security camera in the Pasco County McDonald's parking lot. Because the tape shows Makowski to be the aggressor, the Florida State Attorney's office on Monday ruled the death an "excusable homicide."

If there was enough info I'd say hell yeah. If somebody poses a true bodily risk to you and violently pursues a confrontation - I say defend the shit out of yourself.

I voted yes. There are too many laws protecting the criminal, and ignoring the victim.

I voted no. It's one thing to defend yourself, quite another to defend yourself, particularly where there are no arms involved...

Of course this is Florida - they get away with crap like this...

I don't need as much info as some of you. I'm glad he choked the shit out of him. Next time maybe he will carry a handgun and just cap the mofo. It's much quicker, easier and less tiring. :)

It depends.

I don't have enough information about the "aggressor" and if the "aggressor" was incapacitated BEFORE he died.

This is borderline, but I think if he was able to strangle someone to death, on average, that usually means he could have disabled or restrained him without killing him. It seems to me, with what little I have, that this man was overzealous about protecting himself, and is probably a little more than just someone defending himself. He seems to have killer tendencies.

It's hard to strangle someone physically and emotionally. I suppose his military training explains the action, but it doesn't lend it integrity.

The attorney's office said all four men involved in the altercation had been drinking.

This throws a wrench into orderly and coherent self defense.

I need to see the video.

I vote "not enough information".

I am kinda wierd in that respect. I am indifferent to death. Everyone dies, just whether or not you are going to accept it when it happens.
