'Bully' Can't Sue Eminem

The appeals court upheld a 2003 decision by a Macomb County judge who composed a rap of her own to help explain her ruling.

"The lyrics are stories no one would take as fact/they're an exaggeration of a childish act," Circuit Judge Deborah Servitto wrote. "It is therefore this Court's ultimate position/that Eminem is entitled to summary disposition."

Eminem Stands Up to Bully

Detroit, Michigan -Eminem won his legal battle against an old elementary school bully, after the court determined that no one would believe Eminem’s version of the story. DeAngelo Bailey, 32, admitted to bullying the rapper, but claims that Eminem’s lyrical account is much more violent than the actual incident.

The case was dismissed in a Michigan appeals court and the previous decision, made in 2003, was upheld. At that time Circuit Court Judge Deborah Servitto ruled that the lyrics were an “exaggeration.”

The lyrics in question were for Brain Damage, a song on The Slim Shady LP. "I was harassed daily by this fat kid named DeAngelo Bailey... He banged my head against the urinal till he broke my nose, soaked my clothes in blood, grabbed me and choked my throat."

According to Bailey, nothing more occurred than a “push and a shove.”

Bailey, now a sanitation worker, claimed the song invaded his privacy by publicizing unreasonable information that put him in a false light.

But on Friday, the judges said the lyrics would not be taken literally by a "reasonable listener".

Firstly, the nonprofit Burning Man organization, known affectionately to insiders as the Borg, posted it after 5 p.m. PT Friday. That, even in the COVID-19 era, is the traditional time to push out news when you don't want much media attention. 
      But secondly, you may have missed its cancellation because the Borg is being careful not to use the C-word. The announcement was neutrally titled "The Burning Man Multiverse in 2020." Even as it offers refunds to early ticket buyers, considers layoffs and other belt-tightening measures, and can't even commit to a physical event in 2021, the Borg is making lemonade by focusing on an online-only version of Black Rock City this coming August.    Read more...
