  8. SATURDAY AM: Brad Pitt's opener, Oscar contender Babel, had the best per screen average. But I hate when this happens: yet another horror movie made No. 1 at the box office this weekend as the studios knew it would (which is why it had no big rivals). I'm told that Lionsgate's Saw III cut through the competition by opening huge with $14 million from 3,167 theaters Friday for what should be a $35.5 weekend. That massive debut was better than Saw II (which earned $12.1 mil its first day out for a $31.7 mil weekend). Read more at Deadline Hollywood
  9. In the Libby Case, A Grilling to Remember With withering and methodical dispatch, White House nemesis and prosecutor Patrick J. Fitzgerald yesterday sliced up the first person called to the stand on behalf of the vice president's former chief of staff. If I. Lewis "Scooter" Libby was not afraid of the special counsel before, the former Cheney aide, who will face Fitzgerald in a trial beginning Jan. 11, had ample reason to start quaking after yesterday's Ginsu-like legal performance. 11. Rental manager to pay $125,000 to settle bias suit • Parents at a Garden Grove apartment complex were fined if their children played outside or made too much noise. An Orange County apartment management company that fined the parents of children who played outside will pay $125,000 to settle a housing discrimination lawsuit. The tenants alleged in their complaint that the complex's managers fined them $25 when their children stepped on the grass or played in common areas of the Stuart Drive/Rose Garden Apartments in Garden Grove. They said the fines were added to the rent. The suit alleges that Laguna Hills-based Bertram Management assessed late fees on unpaid fines, tenants said. 12. It has been a busy couple of months in the world of music file-sharing litigation. The latest comes to us courtesy of Sony BMG, which is the lead plaintiff in the case of Sony BMG et al v. Arellanes. Sony was dealt a setback by the court yesterday, as Judge Richard Schell ruled that the defendant's hard drive can only be examined by a neutral forensics expert, not the RIAA's own experts. We've reported on Sony v. Arellanes before. Kimberly Arellanes was sued by the RIAA in August 2005 after—surprise—MediaSentry found music files shared by someone using an IP address that the ISP identified as belonging to the defendant at the time. 17. Sounds like the former teen heartthrobs have their heads on their shoulders these days... People aren't really aware of what's going on, and they're not used to seeing it so in-depth, like when we're on the phone with the A&R guy saying, 'We don't want to work with this producer'," Zac Hanson tells Billboard.com. "The film is important, not because it's about Hanson -- because who cares, we're just one more band -- but because there are so many similar stories, like what happened to Fiona Apple and Wilco. It's sort of the norm." The group hopes its story will educate the next generation of potential industry leaders. "We went to colleges all over the country to screen [the movie] and did lectures to spread the word about all the changes that are going on right now," Zac says. "There are a lot of new avenues, and people really need to be involved in deciding where this industry goes and how music is sold over the next 10 years."
  18. Sibling pop/rock trio Hanson takes viewers behind the scenes of its three-year struggled with Island/Def Jam while recording its 2004 album "Underneath" on the new documentary "Strong Enough To Break." The film premiered Oct. 22 at the Hollywood Film Festival. In "Strong Enough," brothers Taylor, Isaac and Zac Hanson face a changing industry and major-label executives and producers whose only interest is radio-friendly tracks. Ultimately, Hanson left Island/Def Jam and independently released "Underneath," which debuted at No. 1 on the Top Independent Albums chart. It has sold 137,000 copies in the United States, according to Nielsen SoundScan. Read more at Billboard

  20. LONDON (MarketWatch) -- EMI Music Chairman and Chief Executive Alain Levy Friday told an audience at the London Business School that the CD is dead, saying music companies will no longer be able to sell CDs without offering "value-added" material. "The CD as it is right now is dead," Levy said, adding that 60% of consumers put CDs into home computers in order to transfer material to digital music players. But there remains a place for physical media, Levy said. "You're not going to offer your mother-in-law iTunes downloads for Christmas," he said. "But we have to be much more innovative in the way we sell physical content." Record companies will need to make CDs more attractive to the consumer, he said. "By the beginning of next year, none of our content will come without any additional material," Levy said. Read more at Marketwatch: London If they had paid more attention to the consumer, they would have realized this when the DVD came out!
