The latest bill to gain attention online is [url="http://www.govtrack.us/congress/bills/112/hr3523"]CISPA[/url], or the Cyber Intelligence Sharing and Protection Act. As the title suggests the main goal of the bill is to deal with “cybersecurity,” but with a lack of definition as to what that actually entails, it’s also one of the major weaknesses. In short CISPA would allow companies to spy on Internet users and collect and share this data with third-party companies or Government agencies. As long as the company states that these privacy violations are needed to protect against “cybersecurity” threats, they are immune from civil and criminal liabilities. Some have described the bill as a new SOPA, but it’s nothing like it. Where SOPA was focused on the shutting down of copyright infringing websites, CISPA is directly targeted at individual Internet subscribers, including copyright infringers. While the definition of a cybersecurity threat is rather vague, intellectual property is specifically mentioned in the bill. For example, among many other descriptions CISPA defines a cybersecurity purpose as follows. [i]“A system designed or employed to [...] protect a system or network from [...] theft or misappropriation of [...] intellectual property.”[/i] In other words, the bill would make it possible for ISPs to actively monitor the private communications of subscribers to detect and censor the transfers of copyrighted content. In addition, the personal details of these users could then be freely shared with third parties. It’s hard to not interpret the above as a [url="http://www.techdirt.com/articles/20120402/04425118325/forget-sopa-you-should-be-worried-about-this-cybersecurity-bill.shtml"]huge problem[/url] for people’s right to private communications. While there is little known about how companies and authorities plan to use the bill, it is the vagueness and broad definitions that get people worried. Copyright holders should have tools to protect their rights, but as it stands CISPA completely destroys people’s right to privacy under certain circumstances. This has caused great concern among the public, and a few days ago digital rights group EFF also sent out an alarming message [url="https://action.eff.org/o/9042/p/dia/action/public/?action_KEY=8444"]warning[/url] people about the looming threat posed by CISPA. “There are almost no restrictions on what can be collected and how it can be used, provided a company can claim it was motivated by ‘cybersecurity purposes’,” EFF writes. “That means a company like Google, Facebook, Twitter, or AT&T could intercept your emails and text messages, send copies to one another and to the government, and modify those communications or prevent them from reaching their destination if it fits into their plan to stop cybersecurity threats.” In recent weeks CISPA has gained support from over [url="http://intelligence.house.gov/press-release/co-sponsors-top-100-rogers-ruppersberger-bipartisan-cyber-bill"]100 lawmakers[/url] in Congress, anti-piracy lobby groups such as the BSA and US Chamber of Commerce, but also tech companies including [url="http://intelligence.house.gov/bill/cyber-intelligence-sharing-and-protection-act-2011"]Facebook, Microsoft and Verizon[/url]. These supporters are likely to argue that the bill wont be used as a massive spying machine, but if that’s the case the text should be amended to reflect that. To a certain degree CISPA faces the same problem as SOPA, in that the vagueness of the definitions give rise to speculations, in this case horrific 1984-like spying systems. In its current form CISPA serves only to fuel the paranoid concerns of the public in which ironically the bill itself exists as the security threat. Pending on all of the original cast's participation, of course, I'd gladly pay to see the reunion versions of these five favorites: [b]Clueless[/b] To be honest we doubt that Cher, Josh, Dionne and Murray have changed all that much but it would be so great to see what they're up to nearly 20 years later. Amazingly enough, most of the cast members have worked steadily over the years. Paul Rudd is definitely the MVP of the group and I think Jeremy Sisto takes home the most improved award, thanks to his charming work as a single dad on ABC's hit "Suburgatory." [b]The Breakfast Club[/b] Just like the song advises as it plays over the end credits, I really can't forget about those iconic characters in John Hughes' beloved '80s movie "The Breakfast Club." Sure, there were all those happy ending-esque moments at the end of the film, but what happened afterward? Anthony Michael Hall's Brian definitely went on to great things but did any of the other high school archetypes learn anything and become better citizens of the world? This one would have to be set at the 30-year reunion, but it could be worth it! [b]Varsity Blues[/b] "I don't waaawnt your liiiife." -- John "Mox" Moxon. Ah "Varsity Blues." So many quotable lines and memorable scenes! This one is totally ripe for reinvention, mostly because almost all of the cast members still look very similar to their slightly more baby-faced selves from the '99 crowd-pleaser. Several have benefited from age, CC: Paul Walker, Scott Caan, Ali Larter, Amy Smart. James Van Der Beek definitely still looks the same. Maybe their kids could be playing football together or the school is celebrating that championship team in some way? [b]Can't Hardly Wait[/b] Despite the fact that there is a pretty terrific epilogue at the end of this gem from '98, I'd love to see the gang all back together. Do Preston and Amanda have a perfect little family now or did the fairy tale run its course? I always thought Denise might have had a bigger thing for Preston than she led us to believe. Is Seth Green's sex-obsessed Kenny still attempting to go at it all the time? Let's bring 'em all back to Huntington Hills High to find out! [b]Dazed and Confused[/b] This film is full of so many future superstars and so many memorable lines - most of which were uttered and immortalized by Matthew McConaughey - that a reunion movie would be a real trip. Talk to anyone from the cast now and they all seem to have the fondest of memories from being on that retro set in '92. In pulling a reverse-Godfather, a horse delivers back his severed head to Dany. Things are looking pretty grim - but at least they have dragons, right? [b]»[/b] Theon Greyjoy, a character we were introduced to in the first episode of the series, has always seemed to be impotent and suffers from a wayward confidence. Although he was a ward of the Stark's, he is never let into their inner-circle of trust. Once Theon returns to the Iron Islands, you really start to feel sorry for the guy. Not only does his father disrespect him, but in a ruse to trick and belittle him he also starts to round the bases with his sister. Oedipus might agree: accidental incest is the worst kind of incest. Let's reset the "Days without Incest" calendar back to "0" and move on. [b]»[/b] HBO also decided that it had been too long since they had aired "Cathouse" so they decided to fulfill that void with a new pilot called "Littlefinger's Whorehouse." Prodigy was released from prison last March after serving a three-year sentence and since then he and Havoc have been working to bring Mobb Deep back to their prime, but it seems that a rift between the rappers might derail those plans. On Sunday Havoc shocked everyone when he took to Twitter to air out his grievances with Prodigy, sending insults surrounding Prodigy's time behind bars. In November Mobb Deep dropped their Black Cocaine EP, telling MTV News "this is one of the best projects that you heard coming out of the hip-hop world in a minute,” and they planned to follow that up with their eight studio album Mobb Deep in early 2012. But it seem like things have gone sour since then. The stream of troubling tweets began on early on Monday morning with Havoc poking fun at Prodigy over his apparent affection for Rihanna "@prodigymobbdeep and @rihanna for getting married soon!! @rihanna please confirm!" before things took a turn for the ugly. "@prodigymobbdeep we got a meeting, lets see if u built to show ur face," he wrote, following up with a stream of harsh words. Flava Works, Inc v. Gunter is an ongoing case involving an adult studio plaintiff and a user-submitted video links/video embedding site. It has become so important that some of the world’s leading Internet companies such as Google and Facebook, rights groups such as the EFF and Public Knowledge, and the biggest entertainment companies through the MPAA, have all become involved in the case. First a little background. Marques Gunter owns a site called myVidster, a site designed for users to upload links and embed videos hosted on 3rd party sites. In 2010, adult studio Flava Works filed a copyright complaint against myVidster and 26 Doe users of its service. Flava Works alleged that Gunter had failed to correctly police his site for infringement. Although Flava did not deny that Gunter had responded to specific takedown requests, the company said that despite being made aware of them, Gunter had done nothing to stop a sample of 26 repeat infringers who continually reposted links to infringing material on the myVidster site. In July 2011, a contributory infringement claim was upheld and a preliminary injunction awarded against myVidster. The company was denied a DMCA safe harbor defense after it was said to have not done enough to deal with repeat infringement. “[Gunter] removes videos from myVidster that are listed in DMCA notices, but goes no further. Beyond his mechanical response to the notices, Gunter refuses to concern himself with copyright protection,” Judge John F. Grady [url="http://business.avn.com/articles/gay/Flava-Works-Wins-Preliminary-Injunction-Against-MyVidster-442948.html"]wrote[/url]. “It is true that service providers are not required to police their sites for infringement, but they are required to investigate and respond to notices of infringement—with respect to content and repeat infringers,” Grady added. Noting the importance of the case, late November 2011 the EFF and Public Knowledge filed an [url="http://www.scribd.com/FlavaWorks/d/74733416-Flava-Works-vs-Myvidster-Marques-Rondale-Gunter-Salsa-Indy-LLC-Filed-Non-Party-Motion-to-File-Amicus-Brief-in-Support-of-Defendants-Appellants-Ma"]amicus brief[/url]. The pair said that Grady had gone too far with his interpretation of the DMCA and noted that the law “….does not say when and how service providers must terminate the accounts of ‘repeat infringers,’ nor does it define ‘repeat infringer’.'” Also in November, Internet giants Google and Facebook signaled their interest in the case and their desire to have the original decision overruled. Their submission is complex, but boils down to a common theme. “Lack of certainty not only harms established businesses like Google and Facebook, but may prevent investment in and development of the next Google or the next Facebook. A [recent study] found that imposing greater liability on Internet intermediaries for the actions of their users would have a devastating effect on investment in early-stage Internet companies,” the pair wrote in a joint [url="http://www.scribd.com/FlavaWorks/d/74734810-Flava-Works-vs-Myvidster-Marques-Rondale-Gunter-Salsa-Indy-LLC-Filed-Non-Party-Motion-for-Leave-to-File-Brief-of-Amici-Curiae-Google-Inc-and-Fa"]amicus brief[/url]. With such important issues at stake, and with their interests leaning more towards holding service providers liable wherever they can, on April 4th the MPAA added their amicus brief to the mix. The MPAA wants Judge Grady’s 2011 ruling upheld. “Contrary to the assertions of myVidster and amici Google and Facebook, search engines and social networking sites are not the only businesses that desire certainty in a challenging online marketplace,” MPAA [url="http://www.scribd.com/FlavaWorks/d/88273497-Flava-Works-vs-MyVidster-AMICUS-BRIEF-by-MPAA"]wrote[/url]. “MPAA member companies and other producers of creative works also need a predictable legal landscape in which to operate.” “By advertising infringing material, refusing to terminate any of its users’ accounts, and failing to identify and stop infringers who repeatedly embedded links to unauthorized video streams and displays, myVidster did not qualify for safe-harbor protection,” the MPAA continued. Again, the brief submitted by the MPAA is highly complex, but it too can be boiled down to a simple interest. “Given the massive and often anonymous infringement on the internet, the ability of copyright holders to hold gateways like myVidster liable for secondary infringement is crucial in preventing piracy,” the MPAA states. In keeping with that theme and according to a statement from Flava Works CEO Phillip Bleicher seen by [url="http://business.avn.com/articles/legal/MPAA-Files-Amicus-Brief-in-Flava-v-MyVidster-7th-Circuit-Appeal-472406.html"]AVN[/url], Flava Works are also suing the web hosts of myVidster. US-based Voxel.net and Netherlands-based LeaseWeb.com are said to be on the hook “…for failing to remove MyVidster.com from its servers despite dozens of DMCA notices alerting Voxel.net and LeaseWeb.com that Gunter was a repeat infringer. Under DMCA, safe harbor no longer applies to sites that fail to remove repeat infringers.” Flava Works, Inc v. Gunter, currently up before the 7th Circuit Court of Appeals, is one of the most important copyright-related cases around and definitely one to keep an eye on.
