Both sides often stress their interdependence, but also their differences in opinion. A new letter sent to lawmakers by the Computer & Communications Industry Association (CCIA) is an example of the latter. On Thursday the House Judiciary Subcommittee on Courts, Intellectual Property, and the Internet [url="http://judiciary.house.gov/hearings/113th/hear_07252013.html"]organized a hearing[/url] on the role of copyright as a driver of innovation in the United States. For copyright holders this was a good opportunity to remind lawmakers why they need strong copyright protections. On the other side, however, other voices tried to balance the debate by arguing that more copyright protections are no guarantee of more innovation. The [url="http://www.ccianet.org/index.asp?bid=11"]CCIA[/url], which includes members such as Google, Microsoft and Facebook, submitted a statement debunking what they see as copyright industry propaganda. The tech industry association explains that tougher copyright can actually hinder innovation. “Arguments that ever stronger regulation incentivizes innovation overlook the ways in which excessive protection can inhibit innovation,” the CCIA writes. “Every year that a work is covered by a copyright is a year that subsequent users cannot build on that work. While incremental protection may provide additional reward to the author, society pays for this reward by being deprived of follow-on use, while the author and his or her heirs accumulate profits.” “For this reason, protection exceeding the amount necessary to incentivize innovation represents a dead weight loss to the economy” The tech companies provide many examples of how more enforcement can be detrimental to innovation. In addition, they stress that under current copyright law this is already taking place. Among other things, CCIA mentions that with statutory damages of up to $150,000 per copyright infringement, copyright holders can put enormous legal pressure on small tech companies. “The threat of enormous damages encourages rights-holders to assert aggressive theories in the hope of coercing quick settlements, and also causes technology companies to withhold new products and services from the market. Effort to quantify the amount of innovation caused by IP must also account for the amount of innovation inhibited by remedies of this nature.” The tech companies further note that copyright trolls are abusing high statutory damages to force individuals into paying settlements, such as in the numerous mass-BitTorrent piracy lawsuits that are currently ongoing. “The feature of the copyright system that most incentivizes aggressive litigation postures, encourages trolls, and thereby chills innovation, is the availability of statutory damages in copyright infringement cases. Under [copyright law], a plaintiff can obtain up to $30,000 in damages for each work infringed, regardless of the actual injury it suffered.” Finally, the tech companies say that the copyright lobby often uses subjective statistics to back up their requests for tougher copyright laws. “For years, advocacy for stricter copyright has relied on rights-holder supplied data, some of which has been openly questioned by governments and intergovernmental organizations,” CCIA writes in its letter. Among other examples they cite the Government Accountability Office report which found that there is [url="http://torrentfreak.com/u-s-government-recognizes-benefits-of-piracy-100413/"]no solid evidence[/url] that piracy leads to massive losses. The tech companies also cite several journalistic investigations, some of which describe the industry-funded reports as “fiction.” “Media investigations into the source of such industry-driven statistics have found little or no basis for these numbers, dismissing them as ‘fiction.’ Objective analyses indicate that rights-holder-funded research has drastically overestimated counterfeiting and copyright infringement costs,” CCIA writes. The above are just a few highlights of the letter, which is available in full below. The document makes it crystal clear that on some topics the tech and copyright industry have certainly not settled their differences. This makes Government plans to realign copyright law with the present times a tough project. Both sides are expected to crank up lobbying machines to make sure that their voices are heard.   12. After dabbling with the Raspberry Pi we were naturally interested when an even smaller BitTorrent-capable device was offered for review. The CuBox (pronounced ‘queue box’) arrived in a small and basic cardboard box – no expensive (needless?) Apple-style retail packaging here. Inside were some basic instructions and just two other items – a power adapter and the CuBox itself. The CuBox (CuBox Miniature Computer) is very small indeed. Living up to its name, it’s a cube measuring 2x2x2 inches (5x5x5cms) weighing in around 90g. The image below shows the CuBox next to a Raspberry Pi for comparison. According to creators [url="http://www.solid-run.com/"]Solid Run[/url], the CuBox is an 800mhz Arm-based computer with 1GB DDR3, an OpenGL graphic engine and a 1080p video decoder engine (full specs [url="http://www.solid-run.com/mw/index.php/CuBox_hardware_specification#Detailed_hardware_specification"]here[/url], comparison with other small computers [url="http://www.solid-run.com/general/60-cubox-vs-the-world-a-little-benchmark-comparison"]here[/url]). Its interfaces with the outside world include a gigabit ethernet port, HDMI for video out, a couple of USB2.0 ports and a Micro SD slot (with 4GB card included). In the main the connections are all on one side of the box, as illustrated in the picture below. [img]http://torrentfreak.com/images/cubox1.jpg[/img] The eagle-eyed will notice that the CuBox has some additional connections the Raspberry Pi does not such as eSATA-II (for an external hard drive) and SPDIF. It also has an infra-red receiver for managing the device via remote control. To get the best out of the device you’re also going to need a USB memory stick, USB mouse/keyboard, ethernet lead and an HDMI lead and TV/monitor. The CuBox usually comes with Ubuntu pre-installed but there is an [url="http://www.solid-run.com/mw/index.php/CuBox_Installer"]installer[/url] and an accompanying [url="http://www.youtube.com/watch?v=XfLJAchNu2c"]video[/url] in case any other distros or software packages are required instead. It’s not ridiculously simple to set up but it’s notrocket science so if you can follow some fairly straightforward instructions you’ll be quickly up and running. For our tests we took a look at [url="http://www.geexbox.org/"]GeeXbox[/url], an open source Linux distro thats pack several multimedia applications into one place to make a neat home theater experience. The user interface is based on XBMC so that’s where we jumped in. [img]http://torrentfreak.com/images/geexbox.png[/img] We’ve covered some of the things [url="http://torrentfreak.com/cord-cutters-rejoice-xbmc-now-sets-itself-up-with-a-couple-of-clicks-130101/"]XBMC can do[/url] in the past, so this time we’ll look at what CuBox can do on the BitTorrent front. Once the device is connected to your network and assigned an IP address, CuBox is accessible from other devices such as your desktop computer or smartphone. Since GeeXBox already contains ruTorrent, a web frontend for the rTorrent client, we can access a full-featured torrent client by entering the CuBox’s IP address (192.168.2.XXX in my case) followed by /rutorrent. At this point it’s wise to flick through ruTorrent’s settings (settings > connection) to assign your preferred port and upload/download limits etc. You’ll then need to go to the ‘download’ tab to tell ruTorrent where to save your downloads. All that remains is to browse to any torrent site (not The Pirate Bay since they only have magnets) and download a torrent to your desktop machine. Simply dragging and dropping that torrent to the web browser window displaying ruTorrent will initiate the transfers in the CuBox. For the security conscious, traffic can be routed through a VPN. [img]http://torrentfreak.com/images/cuboxrutorrent.png[/img] At this point any TV attached to the CuBox can be safely turned off until the downloads complete. What’s also neat for the environmentally aware is that CuBox operates on just three watts of power, even less than required by a Raspberry PI and a fraction of that consumed by a light bulb. Of course, once downloads are complete the TV can be turned back on and XBMC can be used to enjoy the recently obtained media, whether that’s video or audio. SPDIF connector aside the CuBox lacks a dedicated audio out jack though, so the sound quality will be limited to that offered by your TV. There were a few little niggles when setting CuBox up but nothing that couldn’t be solved after a breath of fresh air and the dumping of a faulty USB memory stick. At times the CuBox was also running close to its full usable memory so the Pro version with twice the RAM might be an option for power users. That said, video playback was always smooth, even if (just like the Raspberry Pi running XBMC) mouse response was sometimes a little laggy.
