  5. The tech industry is facing turmoil at this time, with mass layoffs affecting thousands of employees. But the undercurrents of the industry, for those remaining and those fighting to remain, are just as turbulent. For marginalized people who work in technology, the battle is nearly constant: to be recognized, to progress, and to endure in a field that is laced with bias and exclusion. For people of color, women, LGTBQ people, and those who have been historically discriminated against, working in tech continues to be difficult. These issues range from lack of diversity in the workplace; a dearth of well-being practices in the office; less opportunities for progression; disparities in salary — the list can and does go on. Recent data paints a sombre picture of the repercussions impacting those in tech. Statistics from Wiley-Edge, a leading talent and re-skill training partner, published their U.S.-based Diversity in Tech report in September and found that half of Gen-Z tech workers feel uncomfortable in their jobs because of identifying factors such as gender, race, ethnicity, socio-economic background, or having a neurodevelopmental condition. The aforementioned statistic only rises when it comes to women and LGBTQ workers, of whom 55 percent and 56 percent respectively said they feel uncomfortable in their workplaces. Meanwhile, 61 percent of Black respondents said they feel uncomfortable in their workplaces. Research shows that Black tech workers move jobs more frequently than their peers in their quest to seek progression in their professional lives. When it comes to why young professionals surveyed left their roles, 20 percent cited a lack of belonging in the tech industry at large. There is a disconnect here: a large chunk of businesses — 57 percent — said they "work hard" to implement an inclusive culture within their companies, as evidenced by growing interest in DEI (diversity, equity, and inclusion) arms within corporations. Despite movements to combat harmful work practices and foster healthier working conditions, some struggles have remained the same, leading to low retention rates and marginalized people fleeing their jobs for greener pastures. The tech industry is in need of inherent solidarity, allyship, and values that champion necessary change. For marginalized people in the industry, such values are the key to prevailing. While conversations do seem to be growing in this space, few key organizations and individuals have taken discourse further, functioning with the very purpose of helping marginalized people thrive in tech. This goal manifests itself in various ways, whether it means helping tech workers obtain worthy positions or find their voices in an existing role. It also means looking deeper into the fabric of organizations — and removing stringent barriers that have existed for far too long. ColorintechClosing both wealth and opportunity gaps sits at the crux of Colorintech's mission. Founded by Silicon Valley tech executive Dion McKenzie and ex-Google employee Ashleigh Ainsley in 2016, the organization was designed to increase representation of minorities in Europe's tech economy. Their mission is to "make Europe the most inclusive tech hub in the world". This objective is executed by a variety of programs, built by Colorintech, that create access to companies such as Meta, Microsoft, eBay, and Salesforce – all of whom have partnered with the organization. These programs and courses fall into "pathways": "Rise" is designed for entrepreneurs, "NXTgen" is focused on students, and "Advance" is shaped to support current professionals. For entrepreneurs, these programs look like a five-week course for underrepresented founders who have raised less than £500k (around $595k). These founders are advised by a network of experts and are coached on strategies to close deals, expand their customer base, and learn best sales practices. "Working to support minority groups in the UK and across Europe for the past five years, we have helped founders accelerate their ideas and learn best practices while gaining access to a community of fellow founders, investors and experts," Ainsley tells Mashable. NXTgen has several career accelerator programs with specially-designed curriculums around subjects like navigating applications to tech companies, utilizing personal branding, and other skills. Programs for professionals, on the other hand, are aimed at those who are mid-career, are marginalized in their respective workforce, and are looking for their next opportunity. For instance, a recently launched program is directed towards Black tech professionals, offering masterclasses and one-to-one career support in collaboration with communications company WPP. Black women account for just 0.7 percent of tech workers in the UK. These courses are "massive building blocks" for people, says Ainsley. He cites the worrying fact that Black workers "are so heavily underrepresented in the sector" that they currently account for less than three percent of the UK's tech industry. Of that, Black women account for just 0.7 percent of tech workers in the UK. Colorintech has broached this subject broadly in their digital and in-person conference, Black Tech Fest, which this year saw over 5,000 professionals attend from across Europe. "By creating opportunities for powerful conversations around technology, inclusion and innovation, we're on a mission to inspire those who are, or who wish, to embark on a career in technology," he says. Girls in TechGirls in Tech was founded 15 years ago by activist, author, and CEO Adriana Gascoigne, a nonprofit aiming to eliminate tech's gender gap and build a diverse, global workforce. Since, the organization has grown to 130,000 members, who make up a network that is built on propelling professional development, fostering connections, and sharing resources. Gascoign had her own string of harmful experiences while working in tech in the 2000s — a story she shares often with fellow women in tech. "Growing up, all the movies made tech out to be this amazing field where the nerds with good ideas win out – a true meritocracy. On reaching the industry and working at a dozen startups, I pretty quickly found that wasn’t the case at all," Gascoigne tells Mashable. Girls in Tech was initially designed to support women facing discrimination and "an uphill battle just to get jobs" in tech. Now, the organisation works on useful blog content, training, webinars, events, mentorship, even its own podcast, all while building the members community. There's even an all-important job board on the organisation's website. Gascoigne urges those in tech to tackle the root(s) of the issue when it comes to diversity. Of this, education is paramount. "Too often, companies, even the most well-intentioned ones, will try to force square pegs into circular holes by doing what amounts to filling quotas," she says, adding: "DEI can’t just be added to a company’s existing efforts — it needs to be baked into the DNA of the company." "Young people need to see real opportunities in front of them. If companies can build interest and name recognition with diverse young people, they’ll have diverse candidates find them". Watch This Sp_ceLike countless others, Mo Kanjilal co-founded Watch This Sp_ce after working in the tech industry herself. While she reached a senior management role at a tech corporation, she faced "a lot of bullying behaviour and discrimination along the way", including "being asked to make tea" to people ridiculing her name and throwing out "racist comments". This set of experiences led her to set up the Brighton-based diversity and inclusion company with Allegra Chapman and Rachel Pearson. Watch This Sp_ce wants companies to see the benefits of having inclusive teams. The organization operates like a consultancy, working with companies to initially conduct an "Inclusion Audit" in which they review every element of the way a firm works, then create a personalised roadmap for development and progress. Watch This Sp_ce works with a range of clientele, but Kanjilal focuses on tech companies because of her on passion in "changing the tech industry to be more diverse". Kanjilal and her co-founders created an "inclusion framework", which entails taking a holistic look at an organization, its leaders, staff, clients, and stakeholders. Within these key people, Watch This Sp_ce uses information like data analysis and interviews to examine reputation, goals, and objectives for inclusion and belonging, and the transformational actions needed to move forward. This evaluation helps tech companies to retain its employees by understanding "what changes they need to make and how to drive those changes," as Kanjilal tells Mashable. Symba Ahva Sadeghi, founder and CEO of enterprise tech company Symba, began her career as an intern for the U.S. Department of State. However, working remotely made it challenging to progress, she tells Mashable: "It was so difficult to just get my foot through the door." Sadeghi's experience led her to develop a passion for driving economic mobility and increasing access to the workforce for marginalized people. Symba is the product of this realization: a platform that aims to "open up the workforce" by advocating for paid, accessible, and inclusive internships. The company works with tech firms like digital entertainment provider ViacomCBS, investing company Robinhood, and software company Sprinklr. Symba works with underrepresented university students and postgraduates to secure internships that many have historically had no access to, largely due to pay and location. It works with companies to create and streamline paid, remote, inclusive internship programs and help said companies scale their programs thereafter. Symba also campaigns for the importance of converting interns to full-time employees, and paid internship programs that offer progression and allow for retention. "When you create pathways and access to the workplace, that’s when you can support marginalised people," she says, emphasizing the importance of having representation in the office. "If you don’t have anyone who looks like you, it's hard to feel supported and realise your dreams. You need advocates." "There is no band-aid solution. You have to be all in," she says. BuildWithinLike Symba, BuildWithin focuses on retention, which tech companies so often struggle to accomplish when it comes their marginalized employees. Co-founder Ximena Hartsock identified a dearth of talent in tech. "Marginalized individuals often do not have the same professional networks," she tells Mashable. This, compounded with Hartsock's own background — an immigrant from Chile whose parents are Indigenous — led her to found purposeful, mission-driven startups. "I have a strong accent, I didn't go to Stanford or Harvard, and I am an immigrant Hispanic woman from very poor beginnings," she says. "I had a mix of experiences while building my first startup — and it was very lonely at times. As a Hispanic woman, I found the fundraising exercise particularly difficult." BuildWithin, her latest venture, aspires to "allow non-traditional and marginalized talent to flourish in tech roles". The company helps employers run apprenticeship programs for marginalized individuals, with cohorts that wholly consist of people that have traditionally experienced exclusion and lesser opportunities. These programs see such workers being trained, prepared for interviews, and supported during an ensuing year-long apprenticeship. Hartsock notes the benefits of including multiple user perspectives when building a tech product, and says that interviewers and employers have a responsibility to give marginalized people a chance at a healthy career within tech.   10. Many private torrent sites track user traffic to ensure that when content is downloaded, an agreed amount is uploaded back to the rest of the community. Users can independently maintain their own transfer records, which help them keep track of overall bandwidth used and compliance with site rules, whenever traffic volume is an important factor. But whether they’re held locally, on a torrent site, or by an intermediary service, the usefulness of logs is reversed when they fall into the wrong hands. DanishBytes User Arrested Then Prosecuted Early November 2021, Denmark’s Public Prosecutor for Special Economic and International Crime (SØIK) announced that six people had been arrested following criminal referrals by Rights Alliance. All were members and/or operators of ShareUniversity and DanishBytes. Prosecution of site operators is not uncommon but when it’s deemed in the public interest, pirate site users can also face charges. Every case is unique so criteria differ, especially across national borders, but when evidence shows large volumes of infringement, successful prosecutions become more likely. That was the case when a former DanishBytes user was sentenced last week. According to Danish anti-piracy group Rights Alliance, the 28-year-old man was a regular site member and wasn’t involved in running the site. That being said, evidence showed that for the period January 2021 to November 2021, he downloaded and/or uploaded no less than 3,000 copyrighted works, including movies, TV shows, music, books, audiobooks and comics. Guilty Plea and Sentencing Information released by the National Unit for Special Crimes (NSK), a Danish police unit focused on cybercrime, organized crime, and related financial crime, reveals that the user’s traffic statistics interested prosecutors. “During the period, the man downloaded no less than 100 TB and uploaded no less than 20 TB of copyrighted material,” NSK says. BitTorrent trackers operating a ratio model usually insist on a better ratio of downloads to uploads but DanishBytes’ situation was out of the ordinary. The site launched in January 2021 in the wake of other sites being shut down, so had to get going from a standing start with no users. Even when arrests were being made, the site still had a relatively small userbase, which can limit opportunities to upload more. That may have been a blessing in disguise. Faced with the evidence, the man decided to plead guilty and was sentenced last week at the Court in Vibourg. In common with similar prosecutions recently, he received a suspended conditional sentence of 60 days’ probation, 80 hours of community service, and confiscation of his computer equipment. “I am satisfied with the verdict. With a sentence of 60 days of suspended imprisonment, the court sends a clear signal that not only the masterminds, but also users of illegal file sharing services can risk being punished,” says Beytullaah Karacan, deputy prosecutor at NSK. Rights Alliance Welcomes Conviction The case against the DanishBytes user began with a Rights Alliance investigation and a referral to the police. As part of his sentence, the man must pay the anti-piracy group DKK 5,000 (US$600) in compensation but Rights Alliance director Maria Fredenslund is focused on the deterrent effect of another successful prosecution. “In the Rights Alliance, we have been very focused on getting those behind illegal file-sharing services convicted. But it is equally important that we bring to justice the users who are on these illegal services and who help to keep the services running,” Fredenslund says. “It is an important signal to send that it is not only masterminds who risk prison sentences, but also systematic users. Therefore, it is satisfactory that yet another user has been convicted, and we expect more of these lawsuits in the future.” Earlier this month another DanishBytes user received a suspended sentence for his role on the site. Now that Elon Musk's Twitter is reinstating accounts of users that were previously banned from the platform, including former president Donald Trump, the prospect of Apple and Google banning Twitter from their app stores suddenly doesn't look entirely unlikely. Should that ever happen, Musk says he's ready to simply build his own phone, with (presumably) an app store of its own. "I certainly hope it does not come to that, but, yes, if there is no other choice, I will make an alternative phone," he tweeted in response to a user asking what would happen if Apple and Google booted Twitter from their app stores. Both companies have at one point banned Parler, a right-wing alternative to Twitter, though Apple let it return to its App Store in April 2021, and Google reinstated the app this September after it made improvements to its moderation policies. Musk previously said he would not reinstate any Twitter account without forming a "content moderation council with widely diverse viewpoints," but he quickly backpedaled on that, reinstating Trump's account after conducting a Twitter poll. The company also experienced a wave of impersonations and fake news after Musk decided to turn Twitter's blue checkmark, originally a way to verify a user's identity, into something you can buy for $8 a month (the company is currently reworking the system, and a re-launch is expected on Friday). Apple and Google banning Twitter from their app stores would certainly be an enormous detriment to Twitter, as the vast majority of smartphone users globally would be unable to easily access the app and would need to resort to the web version to use the platform.   19. YouTube is one of the most successful sites ever to grace the internet. The site is extremely easy to use and with almost no barriers to entry, it’s one of the best platforms to build an audience. On the downside, using unlicensed content to gain traction renders successes vulnerable to sudden collapse on the whim of a copyright holder. That could mean a strike, a channel ban, or even a lawsuit. After Arvin De La Santos restreamed the Jake Paul vs. Ben Askren fight on his YourEXTRA YouTube channel in April 2021, Triller filed a DMCA notice and YouTube removed the content. For a channel that specialized in “drama related” topics, the next year of events could’ve taken it to the next level. Triller Lawsuit – June 2021 YourEXTRA built an audience of 113,000+ subscribers and generated 14 million views in just four years, but after Triller hit De La Santos with a full-blown lawsuit in June 2021, the channel went quiet. Filed at a California district court, the scale of Triller’s complaint probably contributed to the silence. Triller described De La Santos as a business entity and sued for copyright infringement (making the content available on YouTube), vicarious copyright infringement (liability for YouTube viewers’ infringement), plus violations of the Federal Communications Act (alleged interception of satellite broadcasts). When combined these overly ambitious claims stretched well beyond six digits but even a partial win for Triller would’ve been devastating for De La Santos. So, in its determination to send a message to pirates, Triller dug in. What the YouTuber needed now was a good lawyer and on October 18, 2021, intellectual property specialist Steven Vondram stepped in to answer Triller’s complaint. Triller Accused of Deception Defendants are required to file an answer but in most cases they consist of a tedious list of yes, no, or don’t know type responses. This one was different. According to the defense, De La Santos was “enticed to settle the alleged infringement” instead of going to court. He reportedly paid a settlement fee to Triller, which came with a release of claims. Things didn’t go to plan. “Thereafter, [Triller] filed this lawsuit and returned the settlement fee (without interest) and now seeks to recover damages and attorney fees that they are not entitled to,” the YouTuber’s attorney informed the court. “This is a deceptive act and practice under California law. The parties have previously agreed and resolved this dispute, which Plaintiff has now refused to honor.” Alleged wrongdoing in hand, De La Santos attempted to turn the tables. He asked for the complaint to be dismissed with prejudice, judgment to be entered in his favor, plus an order for costs and attorneys’ fees incurred to date. Neither Side Gives Ground A joint report to the court in November 2021 revealed a damages claim adjustment but little progress. Statutory copyright damages can reach $150,000 per claim but the report indicated $140,000. Triller’s original complaint demanded $110,000 for each violation of the Federal Communications Act but the report cited an adjusted figure of $10,000. For his part, De La Santos insisted that since he’d settled the matter, he would respond by sueing Triller for damages. Triller warned it would depose both the YouTuber and a “corporate representative” of the YourEXTRA YouTube channel, and conduct discovery to find out how the broadcast was obtained, how it was shared and with whom, and whether any financial benefit was accrued by the YouTuber. Money Makes The World Go Round In March 2022, Vondran told the California district court that a written retainer agreement between him and his client required payment for certain fees “if a settlement wasn’t achieved” and if the lawsuit “moved to litigation,” which it clearly had. Court records show that De La Santos couldn’t actually afford a lawyer so Vondran requested permission to withdraw as counsel for the defense, noting that “YourNEXT is NOT a corporation.” De La Santos could either represent himself or find replacement counsel, but he’d probably be forced to default, Vondran wrote. Triller Wins Partial Summary Judgment With De La Santos apparently in no position to mount a credible defense, five weeks later Triller submitted a proposed summary judgment declaring the YouTuber liable on three grounds: direct infringement, vicarious infringement, and violation of the Federal Communications Act. Against defendants Del Santos, YourEXTRA, and Does 1-10, Triller demanded $50,000 jointly and severally under 17 U.S.C. § 504(a)-(c), $10,000 under 47 U.S. Code § 605 (Unauthorized publication or use of communications), plus reasonable attorneys’ fees and costs. Triller submitted a second, largely unchanged proposed summary judgment this June and in July, United States District Judge Dale S. Fischer agreed that Triller was entitled to summary judgment on the issue of copyright infringement. “Triller has demonstrated that even if Defendants were not actually aware that their conduct constituted copyright infringement, Defendants at the very least recklessly disregarded that possibility or were willfully blind to it,” Judge Fischer wrote. Triller’s Damages Claim Lacked Substance Triller’s $50,000 statutory damages claim for copyright infringement was based on its assertion that “at least one thousand people” chose to watch the fight on the YourEXTRA YouTube channel instead of paying $50 each to Triller.. The theory presented to the court stated that De La Santos had made “several hundred dollars” by gaining around one thousand followers and one million views on his YouTube channel by airing the fight. Given that the fight was quickly taken down by Triller, these numbers didn’t appear to make much sense. There were reasons for that. Surprisingly, Triller’s figures were not obtained directly from YouTube. They were reportedly supplied by social media tracker Social Blade but carried no markings to prove that was actually the case. Even more fundamentally, the viewing numbers related to the YourEXTRA channel overall, not the number of views generated by the infringing fight broadcast. Judge Fischer concluded that the evidence was inadmissible. No Evidence to Support Remaining Claims Either Claims that De La Santos intercepted a satellite broadcast in violation of the Federal Communications Act also fell flat. Section 605 only applies when a broadcast is received from the air and since Triller’s evidence failed to establish that, its motion on that cause was denied. Triller’s claim for vicarious copyright infringement fared no better. While the Judge found the company’s direct infringment claims convincing, no evidence of copyright infringement carried out by YouTube users was presented to the court. Without that, the claim failed. In conclusion, Triller’s motion was granted in respect of willful copyright infringement but denied on all other grounds. Triller responded by filing a motion to dismiss all of the claims denied by the Judge, leaving a single copyright infringement claim intact. Good news for De La Santos then? Not at all. Willful Infringement Late October 2022, with liability for willful copyright infringement confirmed by the Court, it was all but inevitable that Triller would revise its claim. Statutory damages allow copyright holders to receive damages of between $750 and $30,000 per work but, when infringement is willful, the maximum is increased to $150,000. That’s exactly what Triller demanded. In his judgment dated November 16, 2022, Judge Fischer awarded Triller maximum statutory damages of $150,000 for willful copyright infringement plus $20,626.25 in attorneys’ fees. With no means to pay for a defense, De La Santos couldn’t even argue over the small change. If this was a boxing match, both arms would’ve been tied behind his back as Triller punched him in the face. Whether that constitutes a ‘landmark’ victory is for others to decide but if nothing else, a clear message has been sent once again thanks to the availability of statutory damages in copyright cases. Final Thoughts: $150,000 in Perspective The fight itself lasted one minute and 59 seconds meaning that each second cost De La Santos a cool $1,433. According to the Georgia Athletic and Entertainment Commission, Jake Paul’s official purse was $690,000, meaning that De La Santos is now on the hook for just over 21% of Paul’s declared earnings. Triller reported 500,000 PPV buys at $49.99 each, roughly $25 million. Jake Paul reported 1.5 million buys, roughly $75 million. De La Santos will likely regret that night for a long time and there’s no question that Triller wants to send a clear message to pirates. Boxing fans, on the other hand, might point to a much bigger crime. Four boxers who fought on the same card were paid as follows: Jeyson Minda ($8,000), Junior Younan ($25,000), William Jackson ($8,000) and Quinton Randall ($15,000). If we combine all four fighters’ purses, 39 seconds of infringement by De La Santos on YouTube covers the lot. Or it would do if he actually pays anything, which is doubtful. The YouTuber was served at an address in Canada where U.S. Federal and State Courts have no jurisdiction over Canadian residents or companies.   24. The fear of every person who reads too much sci-fi labor dystopia might be coming true: Robots could be replacing workers. Last week, Amazon extended hundreds of its recruiters' buyout opportunities in just one part of a very long, very trying cycle of layoffs expected from the shopping giant. And some of those jobs might have been lost to some new artificial intelligence technology the company has been experimenting with for a year, according to a confidential internal document viewed by Recode. Amazon's AI technology — known internally as Automated Applicant Evaluation or AAE — works by predicting which job applicants have the highest potential of being successful in certain roles, and then fast-tracking them to an interview all without a human recruiter's oversight. According to Recode, it works by finding the middle part of a venn diagram between current Amazon employees and job applicants applying for similar jobs. Amazon did not immediately respond to a request for comment from Mashable. SEE ALSO: TikTok influencers won't stop sending me to their Amazon storefronts If this sounds familiar, it's because it is. Amazon built AI hiring technology a decade ago, but it failed miserably by — you guessed it — discriminating against women. Nathan Esquenazi wrote for Venture Beat that the problem with AI hiring technology in general — not just specifically at Amazon — is that it can enable biases. Esquenazi is the co-founder and chief technology officer of CodePath, "a nonprofit that seeks to create diversity in tech by transforming college computer science education for underrepresented minorities and underserved populations." "Given how much AI-powered hiring tools impact the lives of the very people at greatest risk of bias, we owe it to them to proceed with this technology with extreme caution," Esquenazi wrote. "At best, it can lead to bad hiring decisions by companies that can ill afford the time and expense of refilling the positions. At worst, it can keep smart, talented people from getting high-paying jobs in high-demand fields, limiting not only their economic mobility but also their right to live happy, successful lives." Amazon's new hiring AI might have solved those problems — the internal document acquired by Recode says the new AI is guarded against biases based on race and gender. And Amazon hasn't said directly that this AI will or will not be fully replacing the hundreds of laid-off recruiters. This is an infamous weekend full of deals, bookended by Black Friday and Cyber Monday and heralded by Amazon.
