Sample Clearance

Im a new producer on the set in MD originally from NY.I have a quick question about sample clearance.Is it the producers duty to clear a sample or the record companies.I rarely use samples but before I start to sell any music I figure to ask around about some things.Holla atcha boy if U can help.Thanks <_>

The record labels own all the music and if you use one without asking (and paying) and the track becomes a success then you are doomed. Big labels are evil.
