The site and its owner are accused of facilitating copyright infringement on a massive scale. Through the lawsuit the labels hope to shut down the isoHunt website while receiving over 4 million dollars in punitive damages to compensate for their claimed losses. “The isoHunt Websites have been designed and are operated by the defendants with the sole purpose of profiting from rampant copyright infringement which defendants actively encourage, promote, authorize, induce, aid, abet, materially contribute to and commercially profit from,” the labels wrote in their [url="http://www.scribd.com/doc/83175814/isohunt-scbc"]complaint[/url]. This week isoHunt’s Gary Fung filed a response to the accusations. Turning the tables Fung argues that it’s not isoHunt but the record labels that are the real threat. The labels are waging war on the Internet and trying to restrict basic human rights by trying to shut down file-sharing services, Fung says. “In our latest response to CRIA filed in Court, we ask the Supreme Court to adjudicate this crucial issue of balance between the constitutional rights of people on the Internet to communicate, share and search, versus the rights of copyright industries to limit such rights in the corporate interest of protecting and extending copyright,” Fung tells TorrentFreak. “isoHunt urges the court to examine this issue carefully, for the sake of innovations on the Internet, free exchange of culture, and fundamental constitutional freedoms.” In the pleading [url="http://www.scribd.com/doc/83175073/Response-to-Civil-Claim-Final"]isoHunt explains[/url] how BitTorrent works and notes that isoHunt’s role in the downloading process is relatively small. The site positions itself as a neutral technology platform that merely indexes .torrent files stored across hundreds of websites on the Internet. As such, they are not promoting, authorizing or encouraging copyright infringement, they claim. isoHunt argues that the record labels and other copyright industries are trying to systematically shut down these neutral file-sharing systems. Thereby, they breach basic human rights such as the right to freedom of expression. “Freedom of expression on the Internet is under attack. From SOPA in the US, ACTA internationally, and C-11 in Canada, the same theme is apparent on the agenda of copyright industry groups: instead of dealing with actual copyright violators, they want to shut down technologies and internet services that they say will be used by violators,” Fung told TorrentFreak. “It’s the same alarmist approach that goes back to the VCR and the radio. As the Internet emerges as the de-facto medium of communication, sharing and expression, the control over distribution by copyright industries is threatened.   6. After sweeping the Grammys with an Adele-like force in 2003, Norah Jones hasn't exactly had a disappointing career. But after three subsequent albums that showed signs of Jones stretching beyond the jazz-dusted nocturnal vibe that made "Come Away With Me" such a breakout hit, there's a nagging sense that we know what to expect from her. Even with the occasional assistance of Okkervil River's Will Sheff and current indie darling Ryan Adams, her 2009 record "The Fall" was still, ultimately, a pretty typical Norah Jones record with low-key yet polished songs framing her gently sanded voice. Even her recent album with her side project the Little Willies earlier this year just felt like a more direct acknowledgement of the country elements that always hovered at the edges of Jones' music. Co-written and produced by Brian Burton (a.k.a. Danger Mouse), Jones' upcoming album "Little Broken Hearts" could be the artistic left turn she needed. Jones' appearances on Danger Mouse's spaghetti western-informed 2011 album "Rome" added an element of danger to Jones' typically sultry vocals, and "Little Broken Hearts" seems intent on carrying that idea forward with a cover image cribbed from Russ Meyer's "Mudhoney." The first single, "Happy Pills," came online Tuesday, and Burton's fingerprints aren't hard to see. Backed by a clockwork guitar pulse and heavy-footed drums that could be a half-speed outtake from the Broken Bells sessions, Jones sings with a mix of sass and yearning about getting over the wrong man with a classic R&B refrain of "Please just let me go now." Taken with a pinched, distant chorus of "nah, nah, nah," the song may not entirely put to rest the unfortunate "Snore-ah" Jones nickname among some circles, but it's a promising start. Dotcom had been held in custody since an anti-terrorist police squad raided his Coatesville mansion in January following a lengthy FBI investigation. The prosecution, acting on behalf of the US Government, argued that Dotcom had hidden resources that would enable him to flee the country should he be granted bail. Although four additional bank accounts in the Philippines were discovered, all of them were empty, and the Judge concluded that there was no evidence of significant funds elsewhere As a result the Megaupload founder was released from prison, free to continue the fight against the US authorities who want him extradited to face racketeering, copyright infringement and money laundering charges. When TorrentFreak spoke with Dotcom yesterday he was in [url="https://torrentfreak.com/megaupload-founder-kim-dotcom-were-going-to-win-120227/"]high spirits[/url] but the Crown, acting on behalf of the US Government, had already appealed the decision to free the Megaupload founder. Crown prosecutor Anne Toohey told the court yesterday that since Dotcom’s release last week two further banks accounts had been discovered – one in the Philippines and another in the British Virgin Islands containing $2000. She said that this, along with allegations that Dotcom might have access to forged travel documents, was enough to have the 38-year-old put back in prison. Representing Dotcom, Paul Davison QC argued that it made no sense for his client to try and flee the country, not least because his wife Mona will shortly give birth to twins. Today Judge Tim Brewer agreed, denying the prosecution’s appeal and allowing Dotcom to remain a free man pending an extradition appeal in August. Also in court today, Dotcom and his wife had asked for access to around NZ $220,000 (US $185,130) to cover their living costs including rent of their mansion, security guards and other household staff. The amount would also cover substantial telephone costs incurred as Dotcom prepares his defense, fuel and tutoring for Dotcom’s children. Previously, Judge Judith Potter agreed to release NZ $74,000 from one of Dotcom’s seized bank accounts to pay creditors left out of pocket after the shutdown of his companies. "New Multitudes," a new album by Jay Farrar, Will Johnson, Anders Parker and Yim Yames, is the latest work to mine the vast stash of some 3,000 songs that the great--and prolific--folk troubadour Woody Guthrie left behind when he died in 1967 at age 55. Most of the material now held by the Woody Guthrie Archives is just pages of lyrics, or fragments, with little or no indication of how Guthrie thought the music should sound, so this quartet of alt-rock musicians has been charged with creating original melodies and accompaniment, yielding a cross-generational realization of Guthrie’s ideas. Wisely, there seems to be little attempt to mimic Guthrie’s style and sound. Instead, they’ve put his words into contemporized musical frameworks, creating a sense of what his work might have sounded like were he still around working and jabbing at social and political sacred cows today. These concoctions have inherent charm both from Guthrie’s typically pithy, sometimes deceptively trenchant writer’s eye and from the foursome’s fittingly earnest musical settings. But they also reveal the musical lineage of which Guthrie is both a key disciple and an inspirational fountainhead for successive generations. “Careless Reckless Love” reflects Richard Thompson-like folk troubadour trappings, “Old L.A.” rides along on a fluidly propulsive rhythm echoing R.E.M., “No Fear” accesses the Velvet Underground’s proto-punk minimalism and “ V.D. City” mines the cragginess of John Mellencamp’s heartland rock. “Change the pen, change the ink/Change the way you talk and think/Change the tubes and change the tires/And change the thing your heart desires,” Guthrie wrote in the title tune, exhorting listeners to remake themselves from the ground up if they want to make the world a better place. It’s a notion Farrar, Johnson, Parker and Yames (Jim James of My Morning Jacket) have taken fully to heart here. The quartet comes to L.A. for a March 7 show at the Mayan Theatre.   18. The outdoor concert season is still months away, but the UCLA JazzReggae Festival is already prepping for its Memorial Day weekend event. Now in its 26th year, it's become the largest student-run fest in the country and offers a two-day mash-up of hip-hop, reggae and yes, even a slice of actual jazz. To whet your appetite, the organizers have put togther a series of performance videos from last year’s festival, the first of which is premiering on Pop & Hiss. The video includes a performance of horn-drenched soul courtesy of Lee Fields & the Expressions, who played their weather-appropriate tune “Sunny” for a full crowd at last year's sold-out festival. Singing to an audience packed with locals in lawn chairs and Bruins sporting beach wear, Fields delivered a gut-wrenching love song backed by skintight rhythms from his suit-wearing six-piece ensemble. Almost a year later, the 61-year-old Fields — who went from singing with Kool and the Gang in the mid-'70s to becoming an underground legend in soul music — is preparing to release a new record, “Faithful Man,” on March 13 via Brooklyn-based Truth and Soul Records. The video series will be available on the festival's website starting in March and will feature footage from 2011 performers Little Dragon, the Miguel Atwood-Ferguson Ensemble and others.   20. You know how Paramount Pictures and 20th Century Fox are re-releasing "Titanic" in April but in magical 3-D? Hearing Madonna's latest single, "Girl Gone Wild," released on Monday, makes me wish we could do something similar with her 2000 single, "Music." It was the last time Madonna really sounded like the queen of the dance floor, tapping into the hedonistic rebellion of the club, gettin' loose. "Girl Gone Wild," on the other hand, the second track to be released off the winkishly named "MDNA" due March 26, sounds grimly serious about the business of getting down. You can almost see Madonna narrowing her eyes, pointing at people at the Eurodisco and saying, "You. Writhe. NOW. Thank you." This is a woman, after all, who publicly took an audience member to task for spilling water on her stage when she performed at Coachella. You know, the festival in the middle of the broiling hot desert. Recorded in London with dance music superstar Benny Benassi and his production partner/cousin, Ale Benassi, "Girl Gone Wild" is trim and taut, almost like it was once a fluffy disco tune now dieted down to a hard body of dance effiency. There's something very attractive about a song this militaristic and precise, but in Madge's too-capable hands it's also suffocatingly professional. Over a whip-timed beat and synth call signals, Madonna dispenses with creativity and instead grabs the two nearest lyrical cliches, the title and chorus line "girls just want to have fun," without caring where either one comes from. Cyndi Lauper or Joe Francis -- who cares? She just wanted to conjure good times, people, and this is the quickest way she knew how. Madge’s use of well-worn lines has rubbed some people the wrong way, including Francis himself. He has been beating his chest to the media, saying he sent a cease and desist letter to Madonna. She had originally titled the song in the plural, “Girls Gone Wild,” just like the Francis nudie video franchise. Her longtime manager, Guy Oseary, quickly quashed the rumor that the Material Girl changed the name of the song to appease Francis. It was simply one of the many last-minute tweaks they made to the album, he said. Besides, Oseary sniffed, Madonna doesn't even know who Francis is. It's not that surprising that she doesn't. Can you imagine Madonna doing something as schlubby as watching late-night TV, where "Girls Gone Wild" commercials troll the airwaves? Yep, she's a good girl, that Madonna, not a wild one at all.   23. The party that is Coachella is not just confined to the Empire Polo Fields in Indio, Calif. Music fans who will be invading the desert communities in April know there are plenty of after-parties and mini-concerts to crash and/or attend in the area too. And now that the festival has virtually cloned itself for a second weekend (it'll be held April 13-15 and April 20-22), it presents indie festival planners such as Phil Pirrone with an interesting challenge: supplying all those extra road-weary travelers with something to do while they’re in town. Pirrone and his crew, who are responsible for presenting a regular series of festivals called Moon Block Party in Pomona, recently announced the launch of Desert Daze, an 11-day festival centered at Dillon's Roadhouse in Desert Hot Springs, Calif., about a half-hour drive from Coachella. The plan for the festival, to be held April 12-22, is to present more than 100 bands and DJs from L.A. and beyond who will take over the modest desert venue from 4 p.m. to 2 a.m. daily. For Pirrone, who’s been organizing community festivals for years with varying success, providing a platform for local bands during such a crazy two-week period seemed ambitious but not impossible. “We’ve always wanted to do an extended festival, and all these people being in the desert for an extended amount of time presented a perfect opportunity to make that happen,” he said. The lineup, while it continues to grow, is already packed with local acts including the buzz-worthy psych rock of Long Beach's Crystal Antlers, Santa Ana's Free the Robots, L.A. favorites Dante Vs. Zombies and the D.C.-bred stoner rock outfit Dead Meadow. Desert Daze will feature an outdoor stage, an indoor stage and an intimate “bus stage” created from a gutted-out Greyhound bus-turned-music lounge. When it comes to putting an event like this together, Pirrone says he and fellow organizers have fallen back on the same ethos that's contributed to the grass-roots success of his previous Moon Block Party festivals in downtown Pomona. “Moon Block Party has basically survived by putting 50 bands on a bill who all promote it hard as if it were their own show,” Pirrone said. “And then you have 50 people working behind the scenes to put everything together to produce it and then a bunch of fans and friends really getting passionate about coming to it.” Those in charge of organizing the event are either performing musicians or artists, and they are planning a number of workshops and live art installations in addition to a nonstop barrage of shows. Pirrone hopes to take the stage himself as part of his L.A.-based psych rock duo, Juju. The festival is similar to the homegrown “D-I-T” (do-it-together) events put on by FMLY, and Pirrone says the goal of Desert Daze is to create a solid community in the middle of all that is Coachella. This release of Syndicate, a remake of titles from the 90′s, is written by Sweden-based Starbreeze studios and in common with every software creator in the country, they will be acutely aware of the nation’s close links to the demo, cracking and piracy scenes. In a nod to these rivals, Starbreeze hid away a cool little easter egg on the disc of the more piracy-prone PC version of the game. The file, which was found by Redditor [url="http://eu.reddit.com/user/MikkelManDK"]MikkelManDK[/url], is titled Syndicate-SBZ.nfo and initially looks like the calling cards left by most game copy-protection crackers.
